RBI Guidelines on Cross‑Selling Insurance: What You Must Know as an Agent or Consumer

Insurance should be recommended only based on the customer’s needs and financial capacity, and must comply with all applicable IRDAI rules. Under the RBI’s Wealth Management, Marketing and Distribution guidelines (28 June 2013), banks may distribute insurance as a third‑party product, but must clearly disclose that the policy is not a bank deposit and is not guaranteed by the bank. Banks must obtain the customer’s explicit, separate consent before selling any policy.

Under RBI’s latest directions on third‑party product sales (Responsible Business Conduct framework, 2026), banks must not condition loans, deposit accounts, or any other banking service on the purchase of insurance, and compulsory bundling is prohibited. Banks must not use coercion, false promises, incomplete disclosures, misleading digital practices, or “dark patterns,” and must ensure that insurance agents in branches are clearly identifiable and do not present themselves as bank employees.

Banks must explain the premium, benefits, exclusions, risks, lock‑in/exit penalties, the bank’s role, any commissions or charges, and the complaint‑redressal process, and must assess product suitability (age, income, risk profile, financial literacy, investment horizon) before recommendation. Consent must be explicit (e.g., OTP, digital confirmation, or signed declaration), with a default “No” option and separate approval for each product.

If forced selling or mis‑selling is detected—defined to include selling unsuitable products, incomplete/misleading information, sale without explicit consent, or compulsory bundling—the bank must investigate, provide a full refund of the premium (and compensation where applicable), cancel the sale where feasible, and take disciplinary action against responsible officials. These norms apply to bancassurance and other third‑party products sold through branches, apps, and agents, with key provisions effective from 1 January 2027.

Digital Game Startup (Gameskraft) Case Study: FEMA Violation & Enforcement Directorate (ED) Investigation

In this case study, we examine enforcement actions, timelines, and likely FEMA compliance issues across several digital gaming platforms.

📌 1) Gameskraft:

The Enforcement Directorate’s public release says the case arose from alleged cheating of online real-money rummy players, followed by layering through dividends, buy-backs, mutual funds, bonds, convertible notes, equity, movable assets, and high-value items. It also says the agency used Section 17 of the PMLA for searches and relied on multiple FIRs for scheduled offences.

Timeline:

- Mid-2023: Allegations and initial complaints about cheating and irregularities surfaced in reporting.

- Late 2023 to early 2024: FIRs filed and preliminary investigations by local police and other agencies recorded.

- 2024 (search phase): ED invoked Section 17 of the PMLA and carried out searches linked to alleged money laundering and layering.

- 2025: Proceedings and asset-tracing activity continued, with regulatory scrutiny on corporate and financial flows.

For FEMA, the likely compliance provisions are:

- Section 3 of FEMA, if any prohibited or improper foreign exchange transaction or indirect value transfer was involved.

- Section 4 of FEMA, if foreign exchange or foreign assets were held or used contrary to the law.

- Section 6(3) of FEMA and the relevant Foreign Exchange Management (Non-Debt Instruments) Rules, 2019, if foreign investment, share issues, buy-backs, or downstream investment were involved.

- Foreign Exchange Management regulations under the NDI framework, for pricing, reporting, and investor eligibility issues.

- FEMA reporting regulations such as FC-GPR, FC-TRS, and downstream reporting requirements, if shares, convertibles, or non-resident holdings were part of the structure.

📌 2) Foreign-registered gaming websites:

The ED’s 2023 FEMA search action targeted foreign-registered gaming websites linked to Indian bank accounts in proxy names. Reports refer to operations routed through jurisdictions such as Curacao, Malta, and Cyprus. The reporting suggested suspected remittances and collections through Indian accounts despite offshore registration.

Timeline:

- 2022–early 2023: Media and compliance observers flagged foreign-registered gaming platforms servicing Indian users.

- Mid-2023: ED operations and FEMA searches focused on foreign-registered sites connected to Indian bank accounts and proxy arrangements.

- Late 2023: Follow-up investigations probed payment routing, account ownership, and offshore jurisdictions involved.

For FEMA, the key sections and regulations are:

- Section 3(a) and 3(b) of FEMA, for unauthorized dealing in foreign exchange or payments outside the authorized framework.

- Section 5 of FEMA, if foreign exchange was not used for a permitted current account purpose.

- Section 6 of FEMA, if capital account transactions or offshore structures were used improperly.

- Foreign Exchange Management (Current Account Transactions) Rules, 2000, if remittances were made for purposes not permitted.

- Reserve Bank liberalised remittance and payment-routing rules, if Indian residents funded offshore gaming activity or payment flows were structured through proxies.

📌 3) Coda Payments and Garena Free Fire:

Public reporting said the ED froze about ₹68 crore after alleging unauthorized payments and remittances linked to mobile gaming operations, with some funds allegedly transferred to Singapore. The core concern was the movement of money through Indian accounts and outward transfer linked to the business model.

Timeline:

- 2021–2022: Coda Payments and related payment processors increased collections from app-based gaming across India and other markets.

- 2023: Regulatory attention intensified on cross-border payment flows from gaming apps; reporting noted transfers to Singapore-linked entities.

- 2024: ED froze roughly ₹68 crore in connection with alleged unauthorized remittances and payment routing tied to mobile gaming operations.

For FEMA, the likely provisions are:

- Section 3 for unauthorized foreign exchange dealing.

- Section 4 if foreign exchange or overseas assets were held contrary to law.

- Section 5 for current account remittance issues.

- Section 6 and the relevant capital account transaction rules, if proceeds were moved offshore as part of investment, settlement, or structuring.

- RBI payment and remittance directions, if Indian collection accounts were used in a way inconsistent with the permitted gaming or payment flow.

📌 4) E-nuggets:

Reports said the ED traced more than 300 accounts and seized or froze assets, including Bitcoins, in connection with an online gaming and app-based fraud and laundering probe. The foreign-asset angle makes this matter especially relevant for both PMLA and FEMA analysis.

Timeline:

- 2022: Complaints and suspicious transaction reports prompted scrutiny of app-based gaming collections.

- 2023–2024: ED and enforcement actions traced dozens to hundreds of accounts linked to the app ecosystem.

- 2024–2025: Seizures and asset freezes included cryptocurrencies and other assets; investigations probed cross-border flows and virtual asset usage.

For FEMA, the possible sections are:

- Section 3 and Section 4, if crypto-linked or foreign-value transactions were routed outside permitted channels.

- Section 5, if outward remittances or transfers were made without a permitted purpose.

- Section 6, if the transactions had a capital account character or involved foreign asset holding.

- RBI and FEMA directions on virtual digital asset-linked payments, where applicable through banking or remittance channels.

📌 5) Probo:

The ED reportedly attached assets worth ₹117.41 crore in December 2025, after an earlier freeze of ₹284.5 crore, in a case described as gambling in the guise of gaming. The FEMA relevance comes from how user funds were collected, pooled, and moved, especially if payment flows crossed borders or were structured through intermediaries.

Timeline:

- 2024: Allegations and regulatory interest in platforms operating real-money games grew.

- December 2025: ED attached assets totaling ₹117.41 crore, following an earlier freeze of approximately ₹284.5 crore.

- 2025 onward: Ongoing legal and enforcement proceedings examined the business model, payment flows, and any cross-border components.

For FEMA, the likely provisions are:

- Section 3, if unpermitted foreign exchange dealing or indirect routing occurred.

- Section 5, if funds were sent abroad without a permitted current account purpose.

- Section 6, if any cross-border structuring, foreign investor flows, or offshore settlement was involved.

- Current Account Transactions Rules and RBI payment channel requirements, if the business model depended on collection or remittance patterns inconsistent with permissible use.

📌 6) WinZO:

Reports said the ED charged the company and promoters, alleging rigged real-money games and laundering through overseas entities. That makes this a classic overlap case where offshore structures, foreign payments, and gaming revenue channels may all be under review.

Timeline:

- 2021–2022: WinZO grew as a platform offering skill and real-money games.

- 2023: Media reports and enforcement interest increased around alleged game-rigging and fund movement to overseas entities.

- 2024–2025: ED registered matters and pursued actions against the company and promoters, focusing on alleged laundering through offshore structures.

For FEMA, the likely provisions are:

- Section 3, for any unauthorized forex dealing or value transfer.

- Section 4, if foreign assets or balances were held improperly.

- Section 6, for any outbound investment, overseas entity, or cross-border settlement issue.

- Foreign investment and overseas investment rules, if promoter-related offshore entities or foreign subsidiaries were used in the flow of funds.

ODFC Academy ⭕

The rise of AI and the internet has made speed a defining feature of modern life, but speed without understanding can leave people behind. That is why platforms like ODFC Academy matter. We do not simply respond to change; we help people live through it with greater confidence. In a country where technology is reshaping work, business, and ambition, ODFC Academy speaks to a deeper need: the need to understand, adapt, and move forward with confidence.

The ODFC Academy focus on compliance, finance, legal, tech operations, and regulatory subjects is important because these are the areas that often decide whether a business grows responsibly or struggles under pressure. In a country moving rapidly towards digital systems, online transactions, and AI-enabled processes, the ability to understand rules and risk is no longer optional. ODFC Academy helps make that understanding more reachable.

What makes this especially valuable is the way ODFC Academy turns complicated subjects into something that feels practical and human. Topics such as RBI regulations, reporting obligations, transaction monitoring, and virtual digital asset-related risks can feel intimidating at first. But when they are explained in a structured and applied way, they become less like barriers and more like tools. That shift matters deeply, because knowledge only becomes empowering when people can actually use it.

There is also something quietly important about the ODFC Academy cademy’s approach to case-based learning and bespoke compliance playbooks. In a time when India is moving from familiar systems to digital-first systems, people need more than theory. They need examples, context, and confidence. They need learning that feels connected to real life, because real life is where rules are tested and decisions matter most. ODFC Academy appears to understand that very well.

For many learners, the value of a platform like this is not only in what it teaches, but in what it restores. It restores confidence in people who may feel left behind by the speed of change. It restores clarity in subjects that can feel overwhelming. It restores a sense that professional growth is still possible, even in a world where technology seems to be moving faster than human understanding.

That feeling is especially meaningful in India today, where the digital revolution is not just about convenience but about inclusion. The rise of AI, mobile platforms, online services, and digital financial systems has opened new doors, but it has also created new responsibilities. People need the chance to learn how these systems work, how they are governed, and how to use them wisely. ODFC Academy contributes to that larger national task.

Its wider reach across India gives that contribution even more weight. A platform that can connect with learners across many districts is not only sharing information; it is helping to distribute opportunity. In a country as large and diverse as India, that matters enormously. Knowledge that reaches beyond one city and into many communities can become a bridge between aspiration and achievement.

The emotional strength of ODFC Academy lies in this very idea of bridge-building. It connects professionals with the knowledge they need to work responsibly in regulated environments. It connects districts with national learning. It connects the present of digital transformation with a future that still needs to be shaped carefully. That is the kind of connection that gives a training initiative lasting value.

In that sense, ODFC Academy is more than a training platform. It is part of a larger movement that says ordinary professionals deserve access to the tools of a changing world. It says that knowledge should not remain locked behind complexity. We believe that the future belongs not only to those who build the systems, but also to those who learn how to use it with care.

As India continues its journey through an AI-driven and internet-connected age, institutions like ODFC Academy carry a quiet but important responsibility. We help people stay informed, stay capable, and stay included. That is not a small thing. In a time of rapid change, it may be one of the most meaningful contributions of all.

FCNR (Foreign Currency Non-Resident) A/c for NRI

📍 Anjali: Hey Grace — I’m thinking of moving some USD back to India and investing it myself. Heard of FCNR(B) deposits? Is FX risk still a worry?

📌 Grace: FCNR(B) is ideal for self-directed investors — you deposit in USD/GBP/EUR with an Indian bank and earn interest in that currency. No exchange-rate risk on your principal or interest.

📍 Anjali: Nice. But why are Indian banks advertising higher rates lately?

📌 Grace: Three simple reasons.

- Overseas yields are attractive, so Indian banks must offer a premium to win your funds.

- Hedging and funding costs raise banks’ landed cost; the RBI’s June 2026 facility helps cover hedging costs so banks can offer better gross rates.

- Competition — smaller or newer banks pay higher rates to attract customers who aren’t already with them.

📍 Anjali: What did the RBI change specifically?

📌 Grace: Dec 2024: raised ceilings to ARR +400 bps (1–3 yrs) and ARR +500 bps (3–5 yrs). June 2026: introduced a special facility to reduce banks’ hedging costs — that makes FCNR(B) more competitive versus safe foreign assets.

📍 Anjali: Sounds promising. Any downsides for DIY investors like us?

📌 Grace: Benefits include improved FX liquidity, rupee stability, and reserve build-up. Risks: added exposure on the RBI’s balance sheet and potential moral hazard if support isn’t time-bound. For you and me, also consider bank credit risk, tenure matching, and documentation under FEMA.

📍 Anjali: I’m not confident about FEMA compliance, documentation, or which bank/product suits a self-directed plan. Who can I ask?

📌 Grace: Contact the ODFC FEMA Helpdesk — they provide practical FEMA guidance for individual investors, bankers, and legal advisers on FCNR rules, compliance, documentation, and RBI policy interpretation.

📍 Anjali: How do we reach them?

ODFC Investigation: Free Fire Garena Phishing, PUBG UC Sellers, CODM Activision Deepfakes & Ludo King RNG Hacks

⭕ ODFC.App has uncovered online gaming ecosystems—spread via social engineering on Instagram, Facebook, WhatsApp, and Telegram—as key conduits for advanced digital fraud.

Case examples from ODFC reports:

📌 Free Fire Recruitment Scams:

Scammers pose as Garena scouts on Telegram, offering "clan trial slots" for "entry fees" via UPI QR phishing or GPay redirects. Victims share OTPs for "verification," enabling SIM swaps that drain gaming wallets via micro-transactions. They then push RAT-laden "optimizer APKs" to steal session tokens for account takeover (ATO).

📌 PUBG Mobile/BGMI Pro Trials:

Fraudsters fake UC sellers on Instagram Reels, baiting with "pro squad invites" needing "kit deposits" through crypto tumblers or Paytm proxies. After payment, they use shared biometric "team apps" to drain Royale Pass wallets or sell skins on black markets. Telemetry reveals VPN-chained C2 servers hiding locations.

📌 Call of Duty Mobile Esports Lures:

Impostors mimic Activision on Discord, selling "CODM World League tryouts" with "registration bonds" via PhonePe. They bundle deepfake "analyzer tools" with keyloggers to grab Battle Pass credentials and COD Points for resale. Variants use eSIM burners to dodge KYC.

📌 Ludo King Cash Tournament Fraud:

Fake "high-stakes Ludo leagues" on WhatsApp demand "table buy-ins," then rig RNG via script injection. Screen-share "fair play" links allow clipboard hijacking of UPI PINs. ODFC flags polymorphic phishing mimicking Moonfrog Labs.

Online Gaming Scams: Account, Recharge & Skins

⭕ ODFC.App reports that online gaming—usually promoted via social media platforms like Instagram, Facebook, WhatsApp, or Telegram—has emerged as a major gateway for digital fraud. Many young users have lost hard-earned money or even access to their bank accounts. These scams often begin with fake recharges or forged skin deals. In these situations, the ODFC Cyber Helpdesk provides 24/7 first-line support for victims across India, helping them recover funds, secure accounts, and file proper cybercrime complaints.

How Game-Recharge and Skin Scams Work

In typical game-recharge scams, fraudsters lure users with "cheap skins" or "free coins" on social media. They demand payment via UPI, Paytm, or crypto, then vanish. Sometimes, they trick victims into sharing One-Time Passwords (OTPs) or installing remote-access apps, which drain bank balances or gaming wallets.

Skin-selling scams on Instagram or WhatsApp mimic legitimate traders. Scammers post screenshots of rare skins, share fake trade-history videos, and request advance payments or "security deposits." After payment, they block the victim or claim the skin was "confiscated" by the game server. ODFC reports show many such scams use fake gaming accounts and burner phones, making them hard to trace without proper documentation and helpdesk support.

Real-Life Examples from the ODFC Reports:

📌 Case 1: Fake "Free Recharge" Link on WhatsApp: A college student in Bengaluru clicked a WhatsApp link promising "free 1000 diamonds" for a popular battle-royale game. After entering UPI credentials on a cloned page, over ₹18,000 vanished from his account in minutes.

📌 Case 2: Instagram "Premium Skin Trader": A 19-year-old gamer in Manipur paid ₹12,000 via UPI for CS:GO-style skins offered at 70% below market price. The seller disappeared.

📌 Case 3: "Skin-for-Cash" Bank Account Freeze: A young IT professional in Hyderabad sold in-game skins for cash via a Discord-Telegram group. His bank account was frozen due to flagged "gaming or betting" flows.

FRAUD REPORTED IN A CRYPTO CURRENCY EXCHANGE

This is a troubling story about one of India's leading crypto exchanges, widely promoted through advertisements, that stands accused of manipulating token prices and defrauding users. Recently, a victim reported to us his personal experience of taking a short position on the COAI (Chain Opera) token at $15.51. Almost immediately, the token price on this particular exchange surged to $27–$30, while on Binance and Bybit, it remained near $15.7. His position was liquidated at this inflated price, causing huge losses. Shortly after, the price “normalized” back to around $15.7. Despite showing proof of liquidation on November 7 at 5:22 PM, the exchange denied holding any position for the victim.

The exchange has allegedly deployed various dishonest tactics—manipulating order books, inflating charges, using fake charts, and even causing app disconnections to frustrate users. As reported, a few YouTubers and influencers appear to be paid by them to promote impossible earnings, like turning $400 into $100,000, luring more people into the trap. This sophisticated racket is siphoning off the young middle class’s hard-earned money, operating under the radar of financial regulators like India’s Financial Intelligence Unit (FIU).

In such cases, many victims are left with mounting losses and no effective way to challenge the fraud. This is where the ODFC Cyber Helpdesk steps in to empower users with expertise and resources to fight such crimes. The ODFC Cyber Helpdesk assists users in meticulously documenting their cases, securing critical evidence such as transaction logs and interaction records with platforms, and providing step-by-step guidance on filing complaints and recovering digital assets.

ODFC Cyber Helpdesk, Gujarat

Dr. Ritu (9:10 AM):

Hello, this is Dr. Ritu. I think I’ve been scammed. I clicked on a medical research link from what looked like a trusted journal email, but later I noticed suspicious apps installed on my phone and unauthorized login attempts on my hospital account. What should I do?

ODFC Cyber Helpdesk (9:11 AM):

Hello Dr. Ritu, thank you for reaching out. You did the right thing by contacting us immediately. What you experienced is a case of phishing combined with hidden malware deployment. Did the email link open in your phone browser directly?

Dr. Ritu (9:13 AM):

Yes, it opened in my browser, and then asked me to log in with my hospital account. I thought it was legitimate.

ODFC Cyber Helpdesk (9:15 AM):

Understood. This is exactly where our recommended Remote Browser Isolation (RBI) service could have saved you. RBI loads the risky web content in a secure cloud sandbox before sending the safe version to your device. This way, even if the site is malicious, there’s no chance the malware can directly reach your phone. RBI maintains full functionality, but isolates the threat remotely. We’d strongly recommend enabling RBI for your work and personal browsing.

Dr. Ritu (9:18 AM):

That makes sense. But why did my hospital app also start acting strangely afterwards?

ODFC Cyber Helpdesk (9:20 AM):

That’s another layer of danger. Cybercriminals sometimes try to embed malicious code into apps or web platforms. With Web Application Isolation, the active code of that medical portal would have been executed away in a secure container—keeping your hospital credentials safe from tampering. Using our recommended service, your logins remain secure even if the original app is compromised.

Dr. Ritu (9:23 AM):

I see. So the malware entered my phone system as well?

ODFC Cyber Helpdesk (9:25 AM):

Correct. On phones, once a risky app runs locally, it can attempt to read personal data, including medical research files, contacts, or finances. To counter such risks, we recommend enabling device-side protection through Virtualization and Sandboxing. These isolate risky applications into safe compartments, preventing them from accessing sensitive files or spreading deeper into your phone system.

Dr. Ritu (9:29 AM):

But I use so many apps. How do I separate work-related ones from the casual ones?

ODFC Cyber Helpdesk (9:32 AM):

Good question. Here, Work Profiles or App Isolation Tools come into play. For example, on Android devices, tools like Shelter create a separate work profile. That way, even if you install an experimental medical app from a smaller developer, it cannot interact with your primary data—your contacts, accounts, or patient files remain compartmentalized.

Dr. Ritu (9:35 AM):

That’s very reassuring. But I’m worried about what might already be hidden in my phone.

ODFC Cyber Helpdesk (9:37 AM):

Don’t worry—we can guide you through safety measures right away. For immediate scanning, your device’s own security tools can help. For instance, Google Play Protect automatically scans for harmful apps, manages permissions, and blocks unverified installations. Combined with our continuous monitoring, this lowers exposure to hidden threats.

Dr. Ritu (9:40 AM):

I wish I had known earlier. Is this guidance available anytime?

ODFC Cyber Helpdesk (9:42 AM):

Absolutely, Dr. Ritu. With the ODFC Cyber Safety Services, you have access to 24-hour free guidance and step-by-step safety practices. Remember, prevention is far easier than recovery in cyber safety, and our services are designed to always keep you a step ahead.

Dr. Ritu (9:44 AM):

Thank you. I’ll activate these services right away. This has been a big lesson.

ODFC Cyber Helpdesk (9:45 AM):

You’re welcome, Dr. Ritu. Stay assured, we’re here every hour of the day to protect your digital world. Together, we make cyber safety simple and accessible.

Startup Funding Scam in Gujarat

Samar and his wife, Sakshi, had left behind their stable corporate careers to chase a shared dream — building a premium brand in corporate gifts and perfumes, something elegant and ethical that could set new benchmarks in the industry.

One fine morning, an email dropped into their inbox. A so‑called “Startup Adviser” from a Dubai-based accelerator claimed she had spotted their brand through an “emerging founders’ program.” The timing felt perfect, almost cinematic. Just days later, an Insta advertisement appeared on their feeds, inviting founders like them to a curated pitch session. The details sounded promising —Participation fee: ₹29,000 per founder, framed as a “refundable curation fee.” Add-on offer: ₹199,000 for a “priority VC slot,” guaranteeing face time with investors. Samar and Sakshi, hopeful yet cautious, decided to stretch their budget and signed up.

But on pitch-day, reality looked nothing like the glossy promise. Only 20 founders turned up and not a single “listed VC” was present. The organizers scrambled through excuses—flight delays etc. Everyone was reassured, refunds would happen “shortly.” By noon, the 5-star venue buzzed with whispers: “scam,” “fraud,” “cheating.” By afternoon, chaos reigned.

The aftermath was brutal. Samar felt betrayed. Sakshi, who had convinced her own family about this venture, was heartbroken. But instead of staying in despair, they chose the braver road—to seek justice. When they approached the ODFC Cyber Helpdesk, it felt like a lifeline. To their surprise, the ODFC wasn’t just another complaint portal. It was a continuum of cyber and legal escalation - an instant helpdesk, step-by-step support, and district-level services across India.
